07 November 2015 I have received a letter in October 2015 from IT Dept. asking a reason for non filing of return for A/Y 2013-14.

Situation was in F/Y 2012-13 (A/Y 2013-14)-
1- I employed in a co. from 01/04/2012 to 15/12/2012 and was getting salary after deducting TDS by the co,
From 01/01/2013 i went to US for higher study, so there was no income for that period i.e. from Jan 2013 to March 2013.

2- there was Short term capital loss from trading of shares in F/Y 2012.13.

now i want to file ITR.

Problem-
Under which section ITR -2 should be filed?

07 November 2015 These days such notices are common. When TDS is there in the records of IT Dept and ITR is not filed they issue notice to file. You can give explanation for not filing, if you do not have taxable income.In your case, TDS on salary has been made by employer. Considering all aspects of computation prepare a return of income for AY 13+14 and file electronically. As it is belated return,unless you opt the section other than Sec 139, it can not be uploaded. So select the Section as 142(1) and upload. After that log in to your account with IT and search for compliance tab adn fill the required details to close the issue. EVen before filing the return it is advisable to check " pending issues" and " form 26 AS" online.
