as per my opinion for the A.Y. 2008-09 you liable penalty of RS. 5000/- if department issue any demand notice

For A.Y. 09-10 .... There is no problem fr belated return. For a.y.08-09 you can file return or just let it go if it was not in taxable limit......OR else penalty of 5000 will be there.... even without the notice of AO...
