i have electronicaly filed my i t return for a.y 2007-08 & 2008-09 but not submitted to department can it called as defective return u/s 140

If you have filed your returns with digital signature then you need not submit acknowledgement otherwise you have to submit the acknowledgement. If you have not filed the acknowledgement then the same will not be considered and it is deemed that you have not filed the return.

As it is deemed that you have not filed the return of income therefore question of defective return does not arise.
