When a home loan borrower passes away, their legal heir can continue paying the Equated Monthly Instalments (EMIs). However, to claim tax benefits on the housing loan interest, the loan must be officially transferred into the legal heir's name with the bank's consent. Simply paying the EMI on behalf of the deceased borrower, even as the legal heir, does not automatically grant eligibility for interest claim.

Loan taken by wife. So, when wife dies, legally loan gets closed. If nominee pays her EMI, it is on her behalf. So, nominee is not lone taker, but just care-taker. If bank transfers the ownership of the loan in favor of husband..... then only he can claim any exemption.
