Form inc 9 & 10 in case of foreign subscribers (urgent)

09 May 2015 Dear all,

We are incorporating a company in which both the directors are foreign nationals.

Now since they cant come to India, how to complete the notarization formalities of INC 9 & INC 10.

Also CA has to witness in MOA & AOA that signed in my presence. How to deal with this!

Kindly clarify.

11 May 2015 As far as I know, these forms should be notarised/apostilled in their countries and not in India.

If they are signing the subscribers sheet in foreign, then the witness should be present in front of them. Hence, you can ask any other person who are present with them to sign as witnesses.
