24 October 2009 hello sir i want to know what is d due date of filling form 23B wih Roc. i think auditor has to intimate Roc within 30 days from getting intimation from company regarding his appointment & co has to intimate d auditor within 7 days of AGM

in our case we have not filled 23B for d F/Y 2008-09 last year & we have to file form 23AC of our company Pvt Ltd (client) can we file 23B form now for same year . if we do so what will be d penalty for auditor & will we have to attach appointment letter for 08-09 or recent letter reeived on this AGM

& also by which date we have to file form 23B for this year appointment

24 October 2009 For the financial year 2008-09 you should have been appointed in 2008 itself in agm. You can file the form now but the penalty may come to rs.5000/-. But this should be paid only after the roc initiates. You cannot put recent date.

24 October 2009 for filing form 23B, there is no penalty for late filing to ROC, but for filing Form 23 AC & ACA , you have to pay penalty of 8 times of your normal fees. for SRN of form 23B , you can write as Z9999999 to file form 23AC
