Whether fly ash generated in thermal power plant, Waste or by product?

Under notification no: 1 dt 1st Mar'2011, Fly Ash ( Chapter heading no26) has become dutiable product @ 1% duty without Cenvat Credit & 5% with Cenvat credit.

Fly ash generated in power plant is waste product dutiable on removal.
