is it possible that e-filling of IT return,if below taxable for A.Y 2009-10 without penalty of Rs.5000 i.e discretionary power to A.O

Yes, you can file without penalty if your income before deduction under chapter VI is below taxable limit. However it is more then taxable limit then A.O. can penalised.

You can file the e return without penalty, if total income is below the txable limit.

You can file your return before 31.03.2011 without any question of penalty and whether your income is below or above the taxable limits
