Filling of late return

30 January 2015 Dear Sir,

One of our client has not filed return from A.Y. 2004-05. So now he wants to file for all the assessment years till 2014-15. Whether he can file late return? If yes then for how many assessment years. I know we can file return for A.Y. 2013-14 and 2014-15. Can he file return for assessment years preceding to 2012-13?

Kindly do the needful.

30 January 2015 No as per section 139(4) of Income Tax Act, 1961 Belated return can be filed with in Next A.Y to the Relevant A.Y.

In your case Time limit for filing of Income Tax Returns for A.Y 2012-13 or before that has been expired.

As per my opinion no Remedy is available for Prior Years.

Please consider the Penalty of Rs. 5000/- for A.Y 2013-14 if the Tax is payable.

For A.y 2014-15 I advise to file it on or before 31.03.15 to avoid the penalty u/s 271F
