If a Company is merged with other company and court order approving merger is still to come and it may occured that order may come after 30th September,2010.
In this case, how the Company will file its IT return in time. Is Income Tax allowed any extension for filing of IT Return in this case beyond the control of the Assessee.

If the appointed date of the merger will be from 01.04.2009 then you will have to prepare tax accounts of both the companies and two returns will be filed as if the company has not been merged if the high court order is not received by 30th September.
If appointed date w. e. f. 01.04.2010 then no problem in filing return for last F. Y.
