08 November 2009 dear sir,
pl. let me know what is the last date for filing of ITR of an individual-who is a partner in a firm (having tax audit)for the F.Y.2008-09 ?

08 November 2009 If individual means its july 31st, if tax audit its sep 30th 2009...

08 November 2009 Agreed with expert. However, the last date given is for filing without payment of penalties for late filing. If you file later than that then there is interest and penalties for late filing of return upto March 31, 2010. If filed upto 31/3/2011, then in addition to interest there may also be a penalty. In case partner's own individual account has to be audited, then there is a penalty for non auditing if not completed by 30/9/2009 itself.

The above is assuming that the firm has filed its returns and is audited on time by 30/9/2009. If not, the firm would also have to pay interest and penalties as applicable and the partner is jointly and severally liable for the firms liabilities.

Beyond 31/3/2011 you cannot file return u/s 139 unless you get notice to file under other sections.
