19 January 2008 1.Can a assessee claim both exemption u/s 10(13A)-House Rent Allowance and deduction u/s 80GG- Rent paid?

2. For claiming deduction u/s 80GG whether the place of work and the place of rent paid should be one and the same?

20 January 2008 It is a precondition for claimimg deduction u/s 80GG that the assessee shall not be in receipt of any HRA.

21 January 2008 No,an assessee cann't claim deduction U/S 80GG and exemption U/S 10(13A) simultaneously because it is a preconditon U/S 80GG that for claiming deduction under this section an assessee should not be in recipt of HRA for which Sec.10(13A) exemption can be claimed.

Furthe yes,the place of work and place of rent paod shold be same.
