Kindly suggest

Is excise return required to be filed if the excise duty paid is NIl? if yes then what is the penalty for late filing

23 April 2012 Now, As per Section71 (C) of the Finance Bill 2011 proposed vide Union Budget on February 28, 2011; ‘in Section 70 (1) of the Finance Act, 1994, for the words “two thousand rupees”, the words “twenty thousand rupees” shall be substituted’.

for delay up to 15 days :

Penalty/late fee as per Finace bill 2011 rs. 500

for delay beyond 15 days but up to 30 days

Rs. 1000

for delay beyond 30 days :

INR 1,000 + INR 100 per day (from 31st daysubject to a maximum amount of Rs 20000

25 April 2012 Ramesh Kumar Verma you are telling penalty on not filling of service tax return
while Rita asked penalty on late filling of excise return

As far as Filing of return is concerned as per Rule 12 of Central Excise Rules, 2002, every assessee is required to submit a monthly return of production and removal of goods and other relevant particulars, within ten days after the close of the month to which the return relates wheter there is any excise duty payable or not.

there is no specific provision for penalty on late filing of Central Excise Return but excise officer can impose penalty on late filing
may be nearly 5000.00
