This query is : Resolved

26 July 2021 Sir,
This is Manoj R A CA Inter student, I am currently serving as article assistant for excess leave taken during the 3 year articleship period from 1-12-2020 to 14-07-2021. my question here is how much leave is exempted during above mentioned period and do i need to serve additional period if excess leaves taken during supplementary deed period.

Thank you

07 July 2024 As an article assistant, the maximum permissible leave during the articleship period is regulated by the Institute of Chartered Accountants of India (ICAI). Here’s how it typically works:

*Permissible Leave Calculation:**
- You are allowed a maximum of 156 weeks of leave during the 3-year articleship period. This translates to approximately 108 days of leave (excluding Sundays and official holidays).

*Excess Leave:**
- If you have taken more leave than the permissible limit, it is considered excess leave.
- For any excess leave taken during the regular articleship period (from 1st December 2020 to 14th July 2021 in your case), you would typically need to make up for this excess leave by serving additional articleship period equivalent to the excess leave taken.

*Supplementary Deed Period:**
- If you have entered into a supplementary deed to cover the excess leave period, the additional articleship period specified in the supplementary deed is meant to compensate for the excess leave taken.
- The exact terms of the supplementary deed, including the duration of the additional articleship period, should be adhered to strictly to comply with ICAI regulations.

*ICAI Regulations:**
- It's crucial to follow ICAI guidelines regarding leave and articleship duration to ensure compliance with their regulations. Failure to comply may affect your eligibility for appearing in examinations or completing your articleship.

*Consult with Your Principal:**
- For precise calculations and advice tailored to your specific situation, it’s advisable to consult with your principal or a senior colleague in your firm who can guide you based on the terms of your articleship agreement and any supplementary deeds signed.

Ensuring compliance with ICAI regulations regarding leave and articleship duration is essential to progressing smoothly in your CA journey. If you have any doubts or need further clarification, seeking guidance from your principal or contacting the local ICAI office can provide you with accurate information specific to your circumstances.
