16 December 2012 client is not registered for ESIC. but he is hired labour for contractor n contractor is also not registered for ESIC. Is client liabile for pay ESIC @ 6.5%. to govt.?

17 December 2012 hi

If you have total 20 or more employees drawing salary of less than 15000 employees then you are required to pay ESI.

If you are hiring contractor then if he is satisfying above condition then he is required to pay esic.

If contractor fails to pay esic & if you are bound by CLRA (Contracted Labour Regulation Act) then you being principle employer has to discharge with liability.

Thanks//Vaibhav
