28 January 2014 A Company paid salary on 10th May,2013 for the month of April, 2013. It charge in the ledger on 30 April , 2013.(Back Dated Entry)

a) whether company liable to pay TDS on 7th May or 7th June 2013 for TDS deducted for the month of April , 2013.

28 January 2014 TDS on salary is deposited on payment basis. Liability to pay service tax was 07.06.2013.

If the same thing happen in case of Contractor / Professional fees?

Credit given to Contractor account on 30.04.2013 on back dated basis. But Tds Paid on 7 june. is it oke..?

30 January 2014 No. In the case of ‘Fees for professional services’ or ‘Payments to contractors’ TDS should be deducted at the time of credit of such sum to the account of the contractor/payee or at the time of payment thereof, whichever is earlier. TDS should be remitted to the Govt. on 7th May.
