Is DIR -12 required to file upon completion of term of additional director??? I mean considering it as resignation. Though the term of the additional director is completed, the director name still shown in MCA website.... some professional suggests to file as resignation. please clarify.

As per section 161 (1) of the companies act, such additional director shall hold the office upto the date of next AGM of the Company. If the company wants to regularize such Director as an executive or non executive category , then Company has to file fresh Form for his regularisation and change in designation within 30 days of AGM but if such Director tennure his over as additional director , then company has to file DIR 12 for his resignation within 30 days of AGM and Director has to file DIR 11 for his resignation within 30 days of his resignation
