13 September 2012 If three individuals viz.X,Y and Z desires to form a new company.All of them intends to be first directors and presently they are not directors in any other company.Before submitting the form 1A to get approval of McA,they also obtained their DIN and DSC.Since the company is yet to be formed,they are unable to file Din 2 & 3 and thus unable to register their DSC with the McA.

Can they file Din 2 to the proposed company and thereafter, Din- 3 to the McA.

If not, then I think in such a situation,they have no alternative but to file Form 1A through a PcS/PcA/PwA.

13 September 2012 roll check the DSC of any one director with their corresponding DIN, then file Form 1A and then all forms.

In case of directors, managers or secretaries appointed till 30th June, 2007, filing of form DIN-3 was mandatory.

However, for appointments made on or after 1st July, 2007, form DIN-3 is not required to be filed.

Hence not applicable in case of new company.

13 September 2012 First of all applicant can sign form 1A without roll check with the ROC site.

Secondly, as informed by Ms. Neha now form DIN 3 is not need to be filed.
