Demand u/s 143(1)

16 December 2011 company received notice on 11/11/2011 demanding rs.6649/- u/s 143(1) as not paid related to A.Y 2006-07.demand is received through CPC. and demand payment of tax. when i see 26AS i found that demand is allready paid by comapany as on 25-03-2009.even though they raised the same.

should i reply to notice or its o.k ,as such notice has no meaning. during a.y 2006-07 case has been selected for scrutiny by cass and nil order also given?

18 December 2011 You have to file rectification letter to your ITO with demand paid challan.

1)
IS IT NECESSARY TO FILE RECTIFICATION AS CO. GOT LETTER FROM CPC AND NOT BY PHYSICALLY FROM ITO AND FUTHER, FORM 26AS OF A.Y 2006-07 SHOW THAT CO. HAD PAID AMT. OF DEMAND RAISE UNDER SEC 143(1).

CO. LOST CHALLAN OF DEMAND AMT. PAID BY THEM,AND ONLY PROOF IS FORM 26AS WITH ME.CAN I CLAIME BASED ON THAT FOR RECTIFICATION

3)
IF, CO. DOES NOT ASK FOR RECTI..AS U SAID
DEPARTMENT WILL TAKE ANY ACTION AGAINST
CO.

22 December 2011 1) Yes it is necessary, since as per department there is demand.

2) File rectification with 26AS if the challan is lost.

3) CPC will adjust the demand in future with the refund availaible.

23 December 2011 sir ,should i filed it online or offline ,i dont found option for a.y 2006-07 rectification in online.

i received inti u/s 143(1) dated 06/2/2008 and letter of demand dated 11/11/201 from cpc.
