Delay in it returns

(Querist)
27 September 2012 my friend filed his IT Returns for AY 08-09 on 4.8.10. He had claimed refund about 7 lacs.

Due to some personal problems he could not file his IT Returns on time

Now he is not able to get the refund.

Some of our friends told that we can claim the refund even if there is delay in IT returns u/s 119 / (2) (b)

Please let me know how can we claim refund under this section and what this section describes?

28 September 2012 yes. anyone can claim I T Refund who is eligible to get refund and filed Income Tax Return irrespective of the fact that it is before or after the last date of filing ITRs.
