07 February 2011 Hello Sir,

This is 'Chandan Shahi' a CA student. I wanna know that there is a condition to claim deduction U/S 80GG that Assessee should not be entitled to receive H.R.A.Can it be possible that we add the H.R.A to Other Heads like Basic Salary and others.And show like that assessee is not receiving any H.R.A.Please reply asap.

07 February 2011 The important consideration here for getting the deduction u/s 80GG would be:-

"the assessee should not be in receipt of any house rent allowance which may be entitled to exemption under section 10(13A)"

So the assessee should not get HRA (irrespective of the fact whether he claims exemption on account of this in his return or not)

So the crux is he should not get anything as HRA.

Also if the assessee is paying rent more than Rs. 2,000 p.m. (in most cases he will be :)- HRA exemption would be more beneficial to him
