Custom duty on defective material

28 October 2008 Hi Experts,

We imported the material and paid customs duty also. After receipt of material we found that the quality is not upto our standard and we can't use the material also, subsequently we rejected and scrped the material.

Whether we can able to get back the customs duty from the department whcih we paid for defective material?

Can i get any notification/court judgement in this regard?

30 October 2008 I think the only way to get compensated is to claim from the suppliers.

02 November 2008 Can i get under which section/any notification/judgements?

If the defective material send back to vendor..whether we can claim the refund from customs department?

17 November 2008 These are the some sensitive issue where we must take care.

Is there any contract or MOU between you?
in that once you verify the conditions, and go according to it.

But the fact is you can't get the customs duty refund, u can claim only from supplier.
