23 February 2010 Q Whether custom duty and CVD are claimable or not in the following scenario:-
(A) We import the excisable raw material and manufacture the excisable finished goods and sale it
(B) We import excisable goods for direct sale.

23 February 2010 In the first case, yes. Because you are going to pay duty on the final product.

In the second case, no. Simply because you are trading the goods.

24 February 2010 Dear Mr Rajesh,
You said in first case(A) it will be claimable and in second case it will not be claimable, but now my doubt is that in first case whether only CVD is claimable or both CVD and custom duty are claimable.

26 February 2010 Customs duty cannot be taken as cenvat credit only cvd is elegible in the first case
