05 June 2013 The Company is exempted from cost audit but is required to file compliance report under the cost accounting record rules 2011.

The Company secretary of the company is also a member of the institute of cost accountants. Can he sign the compliance report?

Whether he being the company secretary hinders the signing of compliance report as a cost accountant under whole time employment of the company?

In case of members in full-time employment who would be certifying the Compliance Report of the company where they are employed, their attention is drawn to the above requirement and hereby advised to provide the Institute with full particulars of their employment, designation, employer’s name with address and membership status for updating in the database of the Institute. In case there is mismatch of the member’s status of employment as recorded in the database of the Institute, the validation of the Compliance Report may fail while being uploaded to the MCA Website.

05 June 2013 I am aware that cost accountants in full time employment can sign cost compliance reports. But my question was specific as to:

Whether the Company secretary of a company who also happens to be a cost accountant, sign the report? or say whether a wholetime director of a company whose qualification is of a member of cost institute sign the report?

Pls give attention to the following FAQ answered by MCA. Can u pls interpret the last sentence of the para:

Q. I am holding valid membership of the Institute of Cost Accountants of India as well as of the Institute of Company Secretaries of India. As a full-time employee of the company, can I certify its Compliance Report?

Ans: Yes, being a valid Member of the Institute of Cost Accountants of India and in full-time employment with the concerned company, you can certify its Compliance Report provided you are not signing the Compliance Report as Company Secretary or as Director of the company also.
