13 February 2014 Hello,
As per Circular No. 11/2013 dated 29/05/2013 of MCA, the ROC may obtain decleration/affidavits from subscribers/first directors at the time of incorporation of a company. So, is there any specific format of such decleration/affidavit? If so, please provide.

13 February 2014 Please find the format below:

AFFIDAVIT / DECLARATION

I, (Name of applicant), son/daughter of (name of Father), resident of (complete address), am a Subscriber to Memorandum of Association and Director of the proposed company to be incorporated in the name and style of (Name of proposed company) under SRN No. (SRN of Form 1A).

I hereby confirm and declare that the proposed company shall not accept deposits unless it complies with the applicable provisions of the Companies Act, 1956, RBI Act, 1934 and SEBI Act, 1992 and rules/directions/regulations made thereunder.

Note: The above affidavit should be on Non-judicial stamp paper of Rs. 100 / Franked and should be notarized.
