06 July 2009 A person Mr.x is a consultant in a co-operative society.His son is a auditor in the same society.Is appointment of auditor valid ??? pls answer and also give some reference to prove the above case.and if not valid then what action can be taken against the auditor??pls suggest

07 July 2009 The appointment of auditor is valid. The reason being Mr.X is serving the co-operative society as conultant in his personal capacity. The son can be a auditor.

07 July 2009 consultant cant be tell as an employee....in recent ST case law retainer can be a ee but in companies act they are telling that retainer is not an employe...

in my opinion no disqualification will attract....because

both are giving services on their individual capacity.....will not attract ethics....

but it is an individual judjement for an auditor...if he feels to do...he can get down....for not showin any hands in future
