26 January 2014 if rent is greater than rs.100000 pan is mandatory for claimimg hra.but if landlord is not giving his pan no.than for tax saving purpose a salaried person what can do to avoid tax laiblity on it.

27 January 2014 While making rent agreement mention PAN of landlord & tenant in the agreement. If landlord is not giving his PAN number then submit the rent agreement to your company as well as your Income Tax assessing officer. Otherwise this time claim HRA exemption based on rent payment of Rs 1 lac & from next time onwards include PAN of both in rent agreement.

You can ask him to give either a PAN no. or a declaration that he doesnt have a PAN.
