23 December 2010 I have a query. I hav mentioned wrong PAN for A.Y.2009-10 in ITR-7 of the Trust. But have correctly mentioned in previous years Return nd all other returns. The PAN is wrongly quoted for A.Y. 2009-10 only.

Now what is the procedure. Notice from Income tax is received regarding wrong quoting of PAN.

What is the procedure??

Please reply.. Its Urgent...

24 December 2010 Quoting wrong pan in return is punishable under income tax act with penalty of Rs. 10000/- though it happens by mistake only.

24 December 2010 Sir, but it will be a defective return Sec 139(9). should i submit PAN xerox and Last years Returns copies to Income Tax..

24 December 2010 First let me clear i m nt sir i am student of CA Final.

Your case is not covered under defectiven return as you have furnished pan. A return can be consider defective if you have not furnished PAN.

So in ur case as u r being given a opportunity of being heard u can convince the AO and they have authority to waive the penalty. That is the only last way
