04 October 2012 respected sir/ madam,

we are a charitable trust and a one new thing is came in our institute that security service provider and any other service provider to our institute they should not levy service tax in their bills which they issue to us because education sector is in negative list as per service tax dept.

is this right or not.

05 October 2012 No the education in negative list means education sector doesn't have to charge service tax from students, however in the present case the responsibility of service tax is on security agency and not on your organization as security service is not covered under reverse charge.

11 October 2012 Gupta sir Thanks for your help. but u know what that our accounts & finance manager talk with the c.a of our contractors and gave them
a government notification no.25/2012 - service tax from ministry of finance dated-20/06/2012. and all c.a's are agree with him
