Charging of excise by 1st stage dealer

Greetings for the day.

Can a first stage dealer issue invoice inclusive of excise duty if the purchaser cannot take cenvat??(Purchaser is exempt from excise duty so he cannot take cenvat credit)

25 September 2013 No. Dealer need to issue invoice showing separately excise duty even if buyer of goods is not availing cenvat credit.

27 September 2013 You can issue the commercial invoice and there will be mentioned including value plus tax. Only one invoice can be issued either commercial invoice or taxable invoice.
