can we avail the cenvat credit of service tax at the time of payment of excise duty service tax is paid after removing the goods from factory gate

Yes for eg goods removed on 10 Feb 13 and service tax credit availed on 25 Feb 13. The CENVAT credit of service tax paid can be availed for payment of excise duty which would be due on 6 Mar 13
