Can stay petition be delayed?

08 June 2025 143(1) order was of Oct 2021.
Cut(a) order awaited till today.
Can tax demand stay petition be filed with ao now?

My view unfortunately 220(6) only says within 30 days of demand notice..so i can't right?

09 June 2025 Yes of course stay petition can be filed now also. In case of application of stay petition there is a rule to pay minimum 20% of demand. If in case you have paid the same or CPC have adjusted refunds of other years against this demand which comes to 20% approx then also you can make the application. If nothing has been paid or adjusted , then also u can file a stay petition and request for monthly EMI option to AO and can ask for grant for stay on the full demand amount till disposal of CIT (A)
