Can i file it returns without form 16?

03 April 2012 I have not file IT returns last year and missed the deadline this year too.
the CA near my house told that he needs form16 to file the returns but my company has not yet furnished it to me.

1)If i file the returns this month will i still receive the returns(I have paid more tax)?
2)is there any fine?
3) can i file IT returns with details in my salary slip?

03 April 2012 I didnt understand which is "last year" and which is "this year".
There is a penalty of Rs. Rs. 5,000 as per section 271F if the assessee fails to file return within due date.
Form 16 is required to fill the income tax return. However, it is not required to be enclosed with the return.
Refund can be obtained even if return is filed belatedly. But no interest is paid to the assessee.
IT return cannot be filled with details in salary slip.

04 April 2012 Income Tax return For AY 2011-12 i.e FY 2010-11 can be filed without penality upto 31st March 2012 , After 31st March 2012 it can be filed with a penality of Rs 5000/-

Refund can be claimed.

Although your employer has not given you Form 16, but it can be viewed in 26AS

Therefore their is no worries you can file your return but a penality will be imposed.
