my query is if l & t co was deducted tds u/s 194-c sub contract of person's pan whose truck transport rent on co's contract.can we return file @ 8 % of gross receipt of contract for refund claim for f.y 2010-11

08 December 2011 No you can not file return u/s. 44AD. You have to file return as per section 44AE. TDS made is not a determinative factor to show income u/s. 44AD or 44AE.
