19 February 2016 Does branch office include visioning office or representative office or franchise or project office of company incorporated outside or company incorporate in India.

What are consequences if the company does not describe any establishment as branch and on what basis or criteria the company can describe any establishment as branch

19 February 2016 Deciding whether or not an establishment is a branch or PO depends on the nature of activities. If the establishment does not comply with FEMA regulations relating to Branch / PO then the penalty can range upto 3 times the sum involved. Also FEMA is rigid and is not capable of various interpretations etc. Any violation can only be rectified by Compounding !!!!
