Deciding whether or not an establishment is a branch or PO depends on the nature of activities. If the establishment does not comply with FEMA regulations relating to Branch / PO then the penalty can range upto 3 times the sum involved. Also FEMA is rigid and is not capable of various interpretations etc. Any violation can only be rectified by Compounding !!!!
