23 June 2013 Dear sir,
My friend is currently undergoing articleship and has completed 1 year 9 months of training. She appeared for ICWA inter exams in june 2013 for which she dint fill form 112 as she dint know earlier that it is required. I would like to know is it mandatory to fill form 112 and inform the institute about the pursuance of additional course (even if "no" additional classes were attended in relation to ICWA exams during the office hours)? Moreover, if she wants to intimate the institute now about the course can she do so as she has already appeared for the inter exam of ICWA or should she continue like that only? Also she took leave for her exams with prior permission of her principal but later on after exams her principal refused to have given any permission for the leave. Please suggest any remedy for this situation as to if there is any provision that she can inform the institute now about her ICWA course or shuold she continue like that only? Also, what are the actions that the principal can take? Please reply. Thanks.

23 June 2013 1)yes it is mandatory to submit form 112 as an intimation to icai if you are pursuing additional course during ca articleship

2)No relaxation has been provided for distance education..every one mandatorily required to get permission from icai regarding additional course..more over in case of regular additional course permission will be granted after a strict conditions to student

3)It is strongly recommended to intimate to icai and it will not be a problem as per my knowledge because icai may condone this delay considering icwai is distance course

4)if your principal refused to provide leave for exam days you dont have any option you need to abide by your boss order..

5)yes it is recommended you to inform icwai if you made more delay it will be problem, if you dont want to inform to icai do at your own risk and should invite actions taken by icai if icai came to know about it.

6)If you work against principal order he may write a letter to icai that student was not considering my instructions and i dont him,,and he may expel you from articleship and depends on boss nature he may show you stars by harrassments like not signing either 109 form and may extend your articleship period also

23 June 2013 Actually the pricipal allowed for the leave at first but after the leave when she joined back then he charged her that he doesnt remember granting her any leave.
what to do now? she doesnt even have any proof that he garnted the leave :(

23 June 2013 1)that is why one should request for leave either by mail or by written request letter to principal

2)however you should ask your boss only what to do now and ask him what to do now..and ask excuse for mistake...
