25 April 2009 WE ARE A COMPANY REGISTERED AND OWN RESIDENTIAL FLATS. THE APARTMENT OWNERS' ASSOCIATION CHARGES MAINTENANCE CHARGES AND ELECTRICICTY CHARGES FROM THE FLAT OWNERS. MY QUERY IS WHETHER TDS IS TO BE DEDUCTED ON THESE CHARGES?

25 April 2009 A resident welfare association, which provides services to its members only is not earning any income and hence not paying income tax.
Ask from the association whether they are being assesed for tax or not. If yes, deduct TDS, if no dont deduct.

25 April 2009 Is the concept of mutuality applicable here and hence TDS provision is not at all attracted?
