Dear Experts,
A private Company is not able to hold its AGM on or before 30th September, 2013.
The Company will not violate the provisions of section 166 but will be violating section 210.
In this case do we still need to file an application to ROC for extension of AGM??
And are we too late to file an application?
Please advice.

It is advisable to file form 61 attaching the Board's Resolution and detailed application giving reasons for extension.
05 October 2013
If this is your 1st year then within 15 months you can hold AGM otherwise you can apply for extention
