07 December 2019 A CA Proprietorship firm while filling ADT 1 ..as to file as Individual or Auditors Firm in form ?

07 December 2019 In my opinion Form shall be filed as individual.

Reason: On reading all the sections of chapter X - Audit and Auditors of Companies Act, 2013, It can be observed where ever the word 'firm' is mentioned, there is also a mention of partners of the firm. Ex- Qualification, Rotation etc.
And If One goes through the provisions relating to rotation of auditors it can be observed that if a proprietorship firm is appointed as Audit firm, it will be eligible for re-appointment for second term also which will ultimately defeat the purpose of the law.
