21 January 2017 i have made advance payment for profeasional fee s lets say Rs.10cr , and i have deduct the TDS on the same amount @10% U/s 194J and 9cr transfered to the service provider , after 20 day he reject contract for providing professional service and returned 9cr to me ... so how can i claim TDS of Rs. 1cr which i have deposited in to the govt.account....and now i dont have any TDS liability to Adjust the same .so i need your feed back for the same ..

21 January 2017 Dear Sagar, The only way is to recover the 1cr from the service provider. this is because the credit of one crore has been passed on to in his name. while filing the TDS return, I'd recommend you to file the gross amount as Rs.1/- and TDS as Rs.1cr. that way he can claim refund. but you'll have to recover it from the service provider only.
