44AD 5 Years rule

This query is : Resolved

Quick Summary
This discussion addresses a common query regarding the 5-year rule for Section 44AD of the Income Tax Act. The user previously filed under Section 44AD for two years but failed to file their Income Tax Return (ITR) last year. They are now asking if they can still file under Section 44AD this year, even with an income of £4,00,000, and what the consequences might be. The response suggests that the ability to use Section 44AD again depends on the reason for discontinuing its use in the previous year.

31 July 2023 What if I filled return U/s 44AD 2 years ago, and didnt fill the ITR last year, This time can I file U/s 44AD or not.
The website is accepting the return, what will happen if I file ITR U/s 44AD with 4,00,000 income.

31 July 2023 All depends upon the reason for discontinuation of sec 44AD last year..

11 September 2024 Good Luck.
