clarification to sec139(9)

my client has received 139(9) notice as Error code 3( not filling of P&l , B/s, actually we fill the balance sheet but not p & l as there is no transactions this year so we filled we all data as zero only my question is that we should fill compulsory the schedule of P&l a/c
