WE ARE MANUFACTURAR & MERCHANT EXPORTER
WE DID SOME MERCHANT EXPORTS
WE DEBITED THE DUTY AMOUNT FROM OUR BOND AMOUNT
BUT NOW WE ARE UNABLE TO PRODUCE PROOF OF EXPORT BECAUSE WE DON`T KNOW THAT EXPORT WAS ACTUALLY TOOK PLACE OR NOT BECAUSE OF THE MERCHANT EXPORTERS
I WANT TO KNOW THAT WHAT PANELTY AND FINE WE HAVE TO FACE AGAINST THE EXCISE AUTHORITES
THE MATTER IS OF 2006-07

You have to submit the proof of export to the dept with in six months. if you fails to submit the same you have to pay the duty along with interest. At least you have to submit the Form-H.
In other angle the matter is happend in 2006-07. The dept have to issue a demand notice with in one year from the date of dispach. If they fails to issue demand/show cause notice with in the said period you dont have any problum. If dept issues now is better for you to fight as it is time lapse.
