Tds on foreign trainees

Foreign student come to India on trainee visa for retainer ship and if they earned in India for traineeship .Shall we deduct TDS on the payment which we paid them.

The answer shall depend on the period of stay of foreign trainees in India.

they will be stay in India 6 to 12 Months
But they have business visa but in visa mentioned internship.

If they are for more than 182 days in a financial year,then they shall residents and provisions of sec. 194j may apply.
