Dear sir,

Whether TDS return is require to file if payment is made to NR but TDS is not deducted. Because under DTAA is it not require to deduct??

10 May 2013 If you have filed return for the earlier quarter/months, then you should file the Nil tds return for this transaction.

and if it is the first TDS transaction in which no tds liability arising, then dont file return.

Practically if you have stareted to file TDS return for any earlier period, then you have to file it for the each subsequent period, whether tds was deducted by you or not.

I have already file one return u/s 195.

So have to file other returns even TDS is not deducted u/s 195.
