Shd Notice Period 3M be maintainable as govt job is posted

07 July 2009 Query : Mr. X is working in a college. Recently, X has got government job and posting is expected any time. At this situation, the college Principal is very specific and ordered for 3 months’ notice period and if notice period is not maintained, a sum to be paid as a compensation for the notice period. Suggest me to overcome the situation. Thanks for your guidance.

07 July 2009 If Mr.X appointment order says that 3months notice or 3months pay is required then your principal is correct.

If no appointment order is depicting above condition then one month notice or one month pay will be applicable.

Further please insist to get the acknowledgement for the resignation letter
given to principle.

07 July 2009 Pls see the provisions of particular service rules governing the appointment. It will have a specific provision on the same which would be applicable.
