22 August 2009 Dear Sir,

We are doing job work but some process facility is not availabe with us so that we want to send job work ( By Product )material to onther plant for recovery of solvent & also some job work material send to our onther plant for R & D purpose.

can we send job work material to onther plant for recovery or R&D purpose.

Kindly advice us on urgent basis.

22 August 2009 Yopu can send to other factory for only job work under rule 4(5)a of central excise for processing by taking permission by your Excise devision under notification no.214/86. giving under taking for Excise duty .

R & D is hiddend purpose.

if you use this material then you are liable to pay Excise duty.

22 August 2009 yes ....but under proper permmission from the officer & should b used for mentioned purpose otherwise liable for excise

26 September 2009 Yes. It attracts Rule 4 (5)(a) of Cenvat Credit Rules, 2004. You can send the goods with challan after getting the permision from your AC/DC.
