Can the director of a subsidiary company be appointed as an independent director of its holding company?

According to my view, said appointment will not meet the qualification criteria for independent director
The new act provides that neither
the independent director nor any of his/her relatives Holds or has held a key managerial position or is or had been an employee of the company or its holding,
subsidiary or associate company in any of the 3 financial years preceding the financial year in which he/
she is proposed to be appointed
