Export under rebate

Dear Sir,
We have to export goods to USA from India..but our letter of undertaking has been expired.
so we will have to charge excise and than claim for a rebate.
is there any rule that we can only charge rebate if we have balance in our PLA??
Please guide and help us

You can able to export under rule 18 of CER 2002 read with Notification No. 19/2004-Central Excise (N.T.) dated 6th September 2004, you can utilize Cenvat credit towards payment of duty. PLA balance is not mandate,
