I would like to know whether Education Cess is applicable under DTAA between India & Italy.

14 May 2013 if rate of withholding tax is applied from DTAA, then education cess is not applicable. the rate given in the DTAA will be deemed to be final rate of tax.

15 May 2013 Make sure that Tax Residency Certificate and PAN from Italian Company are obtained before applying India Italy DTAA.
